Terms and Conditions of Use & Sale (EULA)

1. Introduction

This End User License Agreement ("Agreement" or "EULA") establishes the license and usage conditions for the application Esplorando (hereinafter "Application"), provided by Dante AI S.r.l. (hereinafter "Licensor"), a limited liability company with registered office at Via Bocchetto, 6, 20123 Milano, Italy, VAT No. 03341790594.

2. Access, Account, and AI Features

The User is responsible for the security of their login credentials.

• Premium Features (City Pass): Purchasing a City Pass unlocks advanced features such as unlimited itineraries generated by the AI assistant, full audio guides, and special categories (e.g., "Hidden Gems").
• AI Disclaimer: The Application utilizes an Artificial Intelligence system based on internal databases to generate itineraries and responses. Although Esplorando strives to ensure accuracy, the AI may generate imprecise, incomplete, or outdated information. The User acknowledges that the AI is a support tool and agrees to verify critical information (e.g., opening hours, ticket prices) through official sources before traveling.

3. User Conduct and "Zero Tolerance" Policy

It is strictly forbidden to use the Application to: (a) Generate, share, or request illegal, defamatory, obscene, offensive, racist content, or content that incites hate or violence. (b) Attempt to manipulate the AI ("prompt injection") to generate content inconsistent with the touristic purpose of the App. (c) Violate intellectual property rights or privacy of others.

Zero Tolerance Policy: Esplorando reserves the right to immediately suspend or ban the account of any User who violates these rules or uses the chatbot for abusive purposes, without prior notice. Users can report inappropriate content using the specific "Report" function within the App; such reports will be reviewed and addressed within 24 hours.

4. Intellectual Property

All rights regarding the Application, including but not limited to text, graphics, software code, AI algorithms, audio guides, and videos, are the exclusive property of Esplorando or its licensors. The User is granted only a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes.

5. Payments, Third-Party Services, and Refunds

The Application offers different purchasing methods:

• (a) In-App Purchases (App Stores): Subscriptions or digital content purchased directly through the Apple App Store or Google Play Store are subject exclusively to the payment, renewal, and refund terms and policies of the respective Stores. Esplorando does not have the authority to issue direct refunds for these transactions.
• (b) Direct Purchases: Tickets for museums, events, or specific services purchased directly within Esplorando are processed via a vendor secure payment platform. In this case, Dante AI S.r.l. acts as a reseller.
  Right of Withdrawal: Pursuant to applicable consumer protection laws (e.g., EU Directive 2011/83/EU), the right of withdrawal is excluded for the supply of leisure services if the contract provides for a specific date or period of performance (e.g., dated tickets). Therefore, these purchases are non-refundable unless the event is cancelled by the organizer.
• (c) Affiliate Services: Some links or sections in the Application redirect users to external platforms (e.g., Viator) for the purchase of tours and activities. In these cases, the contract is concluded exclusively between the User and the third-party platform. Esplorando assumes no liability for the provision, cancellation, or refunds related to such services.

6. Limitation of Liability

The Application is provided on an "as is" and "as available" basis. Esplorando does not guarantee that the service will be uninterrupted or error-free. To the maximum extent permitted by applicable law, Esplorando shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Application or from reliance on information provided by the AI (including, but not limited to, travel disruptions, missed connections, museum closures, or errors in itineraries).

7. Governing Law and Jurisdiction

These terms are governed by Italian Law. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Court of Milan (Italy), except for cases where consumer protection laws mandate the jurisdiction of the consumer's place of residence.

9. Additional Clauses for Apple Users (iOS)

If the Application is downloaded from the Apple App Store, the User acknowledges and agrees that: (a) This Agreement is concluded between the User and Esplorando only, and not with Apple. Esplorando is solely responsible for the Application and the content thereof. (b) Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application. (c) In the event of any failure of the Application to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price for the Application to the User. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application. (d) Esplorando, not Apple, is responsible for addressing any claims of the User or any third party relating to the Application. (e) The User represents and warrants that they are not located in an embargoed country or on restricted lists. (f) Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement and have the right to enforce it against the User.

10. Additional Clauses for Google Play Users (Android)

If the Application is downloaded from the Google Play Store, the User acknowledges and agrees that: (a) This Agreement is concluded between the User and Esplorando only, and not with Google LLC or its affiliates ("Google"). Esplorando is solely responsible for the Application and the content thereof. (b) Google is not responsible for providing maintenance and support services for the Application. (c) To the maximum extent permitted by applicable law, Google has no warranty obligation whatsoever with respect to the Application, and any refund requests or product support must be addressed directly to Esplorando or through the Google Play refund mechanisms as defined by Google Play policies. (d) Esplorando, and not Google, is responsible for addressing any claims by the User or any third party relating to the Application or the User’s possession and/or use of the Application.
